Introduction

By registering a personal account, you’ll be asked to provide some personal information, as detailed herein and in our Terms and Conditions. 

Datassential, Inc. and our subsidiaries, divisions, and affiliates (“Datassential” or “we”)  understand how important your privacy is and want you to understand how we use your information. This Privacy Policy (“Policy”) applies only to our website: foodsurveys.datassential.com and the related FoodSurveys you participate in (the “Site” or “FoodSurveys”). This Policy will let you know what kind of information we collect on our Site, how we collect that information, and what we do with it. If this Policy or our Terms and Conditions are not acceptable to you for any reason, we kindly ask that you do not use our website or services.

Our Privacy Policy is based on the following provisions:

  • You can request to update or change profile information at any time.

  • You can opt-out of FoodSurveys and close your account at any time.

  • We only store profile information you choose to provide.

  • We don’t forward or transfer your information to any third parties, other than the organizations detailed in this document.

What information do we collect?

We collect, and have collected in the past 12 months, three broad types of information:

  • Information you directly provide us;

  • Information about your use and interaction with the Site; and

  • Information collected through the platform, applications, third parties or other websites.

  1. Information you directly provide us can include:

  • The business name, business title, and business address of your place of employment, along with your name, job title, and email address and password you provide when registering an account;

  • profile information;

  • at your option, we may collect information regarding your ethnicity;

  • any responses you submit during your participation in our surveys;

  • any recorded video surveys you consent to participate in;

  • the content of any customer service correspondence;

  • your login details for other associated apps you’ve registered with; or

  • any other information you directly provide on the Site.

    2. Information about your use and interaction with the Site can include:

  • your IP address, geolocation and data stored in the Site cookies;

  • your activities on the Site, such as when you accept or skip an invitation, your participation in surveys and your progression through a particular survey;

  • your other account activity, such as when you login to your account, when you send us customer service correspondence and when you opt-in to an application;

  • information about the device you’re using to access the Site; or

  • your transaction history, including your account balance, the payments you receive from participating in activities and any rewards you have requested. 

3. Information collected through the platform, applications, third parties or other websites can include:

  • information on our email campaigns from our third-party service providers, including whether you have read an email sent by us or on our behalf, forwarded an email, and when and how many times you have opened an email;

  • public data about you that is made available on other websites such as your contact information or employer information; and

  • information about you that is held by third parties, such as your contact information.

   

We and third parties may use a variety of technologies that collect information automatically, which can include:

  • Cookies - a cookie is a small text file that is sent to your browser when you access a website, including the Site. If you do not wish us to place cookies, you may set your browser to refuse some cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Site may then be inaccessible or may not function properly. Information on deleting or controlling cookies can be found at www.aboutcookies.org

  • “Web beacons” or “tracking pixels” are electronic images, tags, or scripts that allow a website to access cookies and among other things, help track general usage patterns of visitors to a website. We and the third parties described below may use web beacons to compile information regarding your use of the Site.

 

How do we use the information we collect?

Datassential’s use of information.

We use the information you provide us to publish and deliver insights and relevant activities to you and our customers through FoodSurveys and for any other business purposes identified in this Policy. This can include:

  • Sending you emails or notifications to alert you of surveys or sweepstakes for which you may qualify;

  • Using responses from a survey, which has been provided to a business in a de-identified way, for further analysis or use, including publication of the de-identified results;

  • If you choose to participate in a video interview for a survey, your profile and contact information may be provided to our customer conducting the interview;

  • Help detect and prevent fraudulent activity;

  • Maintain the data quality of survey responses;

  • Improve and personalize your FoodSurveys experience;

  • Maintain, operate and improve FoodSurveys;

  • If necessary, to notify you about changes to the Site or to any products or services we offer;

  • As described when you provide the information; 

  • To fulfill any other purposes for which you provide it, or offer your consent; and

  • To comply with our legal obligations and enforce our rights or a third party’s rights.

 

If Datassential undergoes a sale, merger, or reorganization, we may need to transfer some or all of your personal information to a third party or its advisors as part of any due diligence process for the purpose of analyzing the proposed sale, merger, or reorganization or after the sale, merger, or reorganization for the same purposes as set out in this Policy.

Our Customer’s use of information.

There are times when our business customers may require access to profile information such as:

  • Profile information to help determine the target audience for an activity; or

  • The responses you submit during an activity.

All information provided to our customers will be presented in an aggregated and de-identified format, unless you grant us express permission to do otherwise.

Business Customers are also allowed to ask you to provide your name, email address and other contact information during an activity. You should know that:

  • you are providing this information directly to the other business;

  • your information will be dealt with in accordance with the relevant business’ privacy policy and not Datassential’s Privacy Policy; and

  • you are always free to decline providing contact details to a business customer.

 

Information you can use.

 

Information collected through our Site may be used by you to allow you to:

  • create a relationship between your account and other online accounts you’ve registered for;

  • invite your colleagues to join FoodSurveys;

  • communicate with your colleagues and contacts about FoodSurveys;

  • view and access your online accounts through the Site;

  • help detect and prevent fraudulent activity;

  • improve the accessibility of the Site; and

  • participate in retargeting activities.

 

Disclosure to third parties.

In addition to any recipients specified above, we may disclose, and have in the past 12 months disclosed, personal information as described and for the business purposes identified in the below table. We may also disclose your personal information to comply with any court order or legal obligation, including responding to any lawful government or regulatory request, or if we reasonably believe disclosure is necessary to enforce or protect our rights, property, or safety, or that of our users or third parties.

We have not “sold” or “shared” personal information as defined the California Consumer Privacy Act in the preceding 12 months.

Notice of Financial Incentive.

We offer a rewards program in which account holders are automatically enrolled when they sign up for a FoodSurveys account (“Rewards Program”). An individual accrues rewards based upon the number of surveys taken. An individual may redeem the rewards pursuant to our Terms and Conditions, available here[CK2] . An individual may withdraw from the Rewards Program by de-activating their account.

We collect and use the categories of personal information described in the “What information do we collect?” section, including information you voluntarily provide us (such as your name and email) and information we collect automatically to operate the Rewards Program.

Based on our reasonable and good faith estimate, we receive value from the Rewards Program as a result of increased number of surveys taken, though any value will vary by each individual depending on the number of surveys taken, which offers an individual takes advantage of, and many other factors.

Your choice and rights.

Opt-Out.

Using FoodSurveys and maintaining an account is completely opt-in and you may close your FoodSurveys account at any time. You are always able to dissociate your account from any application or website you’ve previously linked to your personal account. 

 

Your Right to Know & Other Rights.

You may have certain rights relating to your personal information, subject to local data protection laws. Depending on the applicable laws and under certain conditions, you may have the right to:

 

  • request the categories of information you have provided to us, our business or commercial purpose for collecting that personal information, the categories of third parties with whom we share that personal information, or the specific pieces of personal information we collected about you, if any;

  • request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes;

  • change and/or correct any information we have about you;

  • request that we delete any information we have about you; and/or

  • not be discriminated against for exercising any of your rights.

 

Should you choose, you may contact us in order to express any concerns that you may have about our collection and/or use of your information. We may deny requests as permitted by law.

 

Exercising Your Rights.

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either: 

 

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. 

You may only make a verifiable consumer twice within a 12-month period. The verifiable consumer request must:

  • provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. To verify your identity, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent.

 

Response Timing and Format.

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

         

Information Security.

We employ industry standard measures to secure your personal information; however, the transmission of information over the Internet and on mobile platforms is not always secure, which means we cannot and do not guarantee the complete security of any personal information you provide to us. The confidentiality of your password for the Site is your responsibility.

 Children Under the Age of 13.

We do not knowingly collect personal information from children under 13. We do not knowingly collect, sell, or share information of consumers between the ages of 13 and 16. In the event that we learn that we have collected personal information from a child under the age of 13 without parental consent, we will delete that information and otherwise comply with the requirements of any applicable law including the Children’s Online Privacy Protection Act.  Retention Periods.

Our retention periods for personal information are based on business needs and legal requirements. We will retain your personal information for as long as is reasonably necessary (i) for the processing purpose(s) for which it was collected or (ii) for any other permitted, linked purpose; or as otherwise permitted or required by law depending on jurisdiction. Where personal information is no longer needed, we may either anonymize the data (in which case we may further retain and use the anonymized data) or destroy the data when legally required.

Changes to this Policy.

We may update this Policy to reflect material changes in the manner in which we deal with personal information, including complying with laws or for business purposes. The Policy posted here will always be current. We encourage you to review it regularly. If we make a material change to this Policy, we will either post a notice on the Site or send you an email (if you have an active email address on file) notifying you of the update. Your continued use of this Site after we make changes to this Policy is deemed to be your acceptance of any changes regardless of whether you receive an email.
